Illinois Confronts Tort “Reform”

As the State of Illinois grapples with the tort reform movement, some of the arguments for and against legislated “caps” on damages in medical malpractice cases are receiving a new airing.  At issue is whether it is fair to impose caps on non-economic damages, such as pain and suffering, despite the absence of caps on economic damages, such as future lost earnings.
